Do You Have a Valid Workers’ Comp Case?

To determine if you have a valid workers’ compensation case, you need to consider these specific laws and requirements:

The most fundamental requirement to having a valid workers’ comp case is to be employed at the time of the injury. Independent contractors, volunteers, and some agricultural workers may not be covered under workers’ compensation in Indiana.

Your employer must carry workers’ compensation insurance. The vast majority of businesses that employ workers are required to provide workers’ comp coverage, but there are some exceptions.

The injury or illness must have occurred as a direct result of your employment or while performing job-related duties.

Indiana law requires injured workers to report their injuries to their employer immediately or as soon as possible.

Obtaining a medical evaluation from a worker’s compensation approved healthcare provider is very important. This will serve as evidence of your injury and its connection to your job.

If you believe you have a valid workers’ compensation claim or are unsure, contact the Ken Nunn Law Office today for a free case review. We’ll be able to go through the details of your injury and help determine if you’re entitled to workers’ comp benefits.

What Workers’ Compensation Benefits Can You Expect?

Indiana workers’ compensation covers all necessary medical treatment for your work-related injury or illness. This includes hospital visits, surgeries, medications, rehabilitations, and more.

Disability benefits are meant to cover lost wages while you are unable to work due to your injury or illness. There are a few different types of disability benefits:

  • Temporary Total Disability Benefits (TTD): If your work-related injury or illness prevents you from working for more than 7 days, you may be eligible for TTD benefits. These benefits are designed to partially replace lost wages, and they are typically calculated as ⅔ of your average weekly earnings (subject to minimum and maximum limits set by the state). These benefits will last until you can return to work, reach maximum medical improvement, or until the end of the maximum period defined by Indiana law.
  • Temporary Partial Disability Benefits (TPD): If you are able to return to work, but at a reduced capacity or lower-paying job as a result of your injury, you may qualify for TPD benefits. These benefits are meant to compensate for the difference between your pre-injury and post-injury wages.
  • Permanent Partial Disability Benefits (PPD): If your work-related injury or illness results in a permanent disability but does not completely prevent you from working, you may be entitled to PPD benefits. The amount and duration of these benefits depend on the nature and severity of the permanent impairment, as determined by medical evaluation.
  • Permanent Total Disability Benefits (PTD): If you are unable to return to any type of gainful employment because of a work-related injury or illness, you may be eligible for PTD benefits. These benefits are paid at the same rate as TTD benefits, but these can continue for life.

If a work-related injury or illness results in death, the deceased worker’s dependents may receive death benefits (very similar to a wrongful death case in other non-work-related accidents). These benefits include compensation for lost wages, based on the worker’s average weekly wage, and a contribution towards funeral and burial expenses.

They are all in my eyes the best and most caring people in the world. They deserve to be put on a pedestal. We tell everyone about them all, and how very helpful they were to both my husband and myself. I had always told people of his service and of how you could stay at home and talk to them on the phone about your business. This helped us a lot. I recommend his office a lot to people before this and will continue to after this.God Bless You All & Thanks

I thought I could handle it myself… I felt like the insurance company gave me the bum’s rush… I couldn’t have done what Ken Nunn did – all the paperwork and the legal ramifications you have to go through… there’s no way an individual without any kind of law firm backing can do this. I was amazed at all the work and time involved…. There’s no was one person can do that. Ken Nunn has changed my life

The insurance company offered me such a small amount that it was unreal. It would have barely paid my hospital bills…. I would recommend Ken Nunn's office to anyone because of the way I was treated. I was treated with royalty. I was the center of attention.

  3. Employer Files Report: Once you’ve reported your injury, your employer is responsible for filing a “First Report of Injury” form with the Indiana Workers’ Compensation Board.
  4. Case Review by Insurance: Your employer’s workers’ compensation insurance carrier will review your claim to determine your eligibility to receive workers’ comp benefits.
