Hurt In Any Accident?

What kinds of safeguards were in place before a recent pick-up truck accident at a camp? Indiana injury lawyers discuss some of the issues

brake failure

A recent accident in an Indiana camp sent a young boy to the hospital with multiple broken bones; it also resulted in injuries for two other kids and a camp counselor.

As reported in the news, a pick-up truck that had been pulling wagons with campers and counselors experienced an apparent brake failure when going down a hill. The vehicle wound up hitting the counselor and three kids.

After any accident, and especially one that involves serious injuries, it’s important to look at the big picture. Could the accident have been prevented? How about the extent of the injuries – would there have been a way to minimize the risk of serious harm?

Just taking this accident as an example, some of the questions we could ask include the following:

What led to the mechanical brake failure?

It could be the fault of the vehicle manufacturer. However, the people who are responsible for maintaining the vehicle may also be at fault, especially if there were prior warning signs that the vehicle wasn’t safe.

Who’s the driver?

Is it the owner of the vehicle, a counselor in the camp borrowing it, or someone hired for the day to drive it around? What’s their safety record on the road, and were they doing anything irresponsible in the lead-up to the accident, such as speeding? If they aren’t the owner of the vehicle, who gave them permission to drive it or employed them?

Was the environment safe?

When the pick up truck was pulling the wagons full of kids and counselors, was it driving along a well-marked route? Was the terrain relatively smooth?

By looking into these questions, we get a better idea of what caused the accident and whether it could have been prevented.

After an accident, Indiana injury lawyers will investigate every angle to establish as clear a picture as possible of what happened. Don’t hesitate to contact us for legal advice and support.
