As wrongful death lawyers in Indianapolis we know that there is no greater heartbreak imaginable than losing a child. These deaths are even more painful when that child’s death was preventable. Well, that is exactly what an Indiana couple believes, and they are taking measures to seek justice.
The couple has filed a lawsuit against the owner of a home day care center that they believe is responsible for the untimely death of their son. At the beginning of the year, they left their infant in the care of the accused, and it was while in that care their baby tragically suffocated. They are looking for compensation to cover medical and funeral bills as well as the grief counseling that they’ve used in an attempt to cope with the tragedy.
In their wrongful death suit, they claim they gave explicit directions that their baby should only consume breast milk and formula for his first six months and the day care gave him cereal as well as a banana. They also gave instruction to not allow the baby to sleep on his stomach and these instructions were ignored and nearly four hours passed without the baby being checked on.
While the baby’s death has been ruled accidental by a coroner, the family believes that the state-licensed day care should be held accountable for negligence that took their son away from them.
